Chapter 13 Bankruptcy Consumer Bankruptcy
I know that when someone comes to my office or dials my phone number that its because I am their last resort. Bankruptcy is not usually the first thing someone thinks of when they run into financial difficulties. Generally, bankruptcy is the very last thing on their mind. At this point the struggle is real and people can be raw. This is not a decision that most take lightly and I understand this. I know that this can be a painful process and that the last thing my clients need is an attorney who does not treat them kindly or with compassion. It is important to me that you feel heard and that you leave my office knowing you are not alone in this.
I have worked for creditors and for bankruptcy trustees, so I am familiar with the operations of each cog of the Consumer Bankruptcy, Chapter 13 Bankruptcy and Chapter 7 Bankruptcy wheel. It is important to me that you understand your position, your rights and what the worst case scenario would be for you should you move forward with bankruptcy, or should you decide that bankruptcy is not right for you. My job is to educate and empower you.
One issue that is becoming more and more relevant these days is the "mortgage deferment" that became rampant during the pandemic. While this tool was established to help people financially by allowing them to take a short break from their mortgage payments, it does not alleviate those payments. As the title suggests, it defers those payments. Unless you specifically ask for the payments to be put on the end of your mortgage, these payments will be due in a lump sum, or possibly monthly installments as soon as the deferment period ends. It is important to remember that even if you have the deferred payments put on the end of your mortgage, they could be written in as a balloon payment. Do your research!
